Terms of Service

These terms govern your use of Treemarks ("the service"), operated by Kransen IT ("we", "us"). By using the service, you agree to these terms.
1. Service description
Treemarks provides cloud storage for photos and videos. Files are uploaded from your device to a dedicated S3-compatible storage bucket. The service is intended as one of your backups — not your only copy.
2. Your responsibilities
- You are responsible for maintaining copies of your data in other locations. Treemarks is a storage service, not an archive of last resort.
- You are responsible for keeping your account credentials secure.
- You must not use the service to store illegal content or content that infringes on the rights of others.
- You must not resell, redistribute, or sublicense access to the service without prior written consent.
3. Availability and data integrity
We make reasonable efforts to keep the service available and your data intact. However:
- The service is provided "as is" without guarantees of uptime or availability.
- We do not guarantee that your data will never be lost, corrupted, or become inaccessible.
- We are not liable for any damages resulting from data loss, service interruptions, or storage failures, whether caused by us, our infrastructure providers, or circumstances beyond our control.
- We rely on third-party infrastructure providers for storage. While we select providers carefully, we cannot guarantee their performance or continued operation.
4. Subscriptions and payments
- Subscriptions are billed monthly. You can cancel at any time.
- After cancellation, the service remains active until the end of the current billing period.
- After the billing period ends, your storage becomes read-only for 30 days. During this time you can download your files but not upload new ones.
- After the 30-day grace period, your data may be permanently deleted.
- Refunds are not provided for partial billing periods.
5. Data ownership
- You own your data. We do not claim any rights to the files you upload.
- You retain full access to your storage bucket and can export your data at any time.
- Upon request, we will provide your S3 credentials so you can access your bucket directly with any S3-compatible tool.
6. Privacy
Our handling of personal data is described in our Privacy Policy. For non-US residents, data is stored exclusively in European data centers.
7. Limitation of liability
To the maximum extent permitted by applicable law:
- Our total liability for any claim related to the service is limited to the amount you paid in the 3 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of use.
- This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise).
8. Termination
- You can terminate your account at any time by cancelling your subscription.
- We may terminate or suspend your account if you violate these terms, with reasonable notice where possible.
- Upon termination by either party, the data retention terms in section 4 apply.
9. Changes to these terms
We may update these terms. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.
10. Governing law
These terms are governed by the laws of the Netherlands. Disputes shall be resolved by the competent court in the Netherlands.
